What changed is the fine print bolted on by Decree 366/2025, which redefined “continuous” to mean you could not leave the country for even a single day across those two years.

In June 2026 a federal appeals court in Buenos Aires ruled that provision unconstitutional and restored the older, sane reading: two years of residence with a normal life — including trips abroad for work, family or a holiday — still counts. The court also confirmed that citizenship is decided by a federal judge, with the public prosecutor involved, not by an administrative office.
